What a Personal Guaranty Means on an LLC Mortgage
Investors form LLCs to create separation between the rental business and their personal lives. Then the loan documents arrive, and there it is: a personal guaranty, asking the members to stand behind the debt individually. Understandably, some borrowers feel like the guaranty gives back what the LLC promised.
The reality is more balanced. The guaranty is the reason lenders can offer entity vesting at all, and understanding what you are signing turns an uncomfortable surprise into an informed business decision. The short version: the LLC borrows, you back it
On an entity-vested DSCR loan, the LLC signs the note and holds title. The guaranty is a separate promise from the members or principals that if the entity does not perform, the lender can look to the guarantors personally.
The property remains the primary security. The guaranty sits behind it as an additional layer of recourse. In day-to-day life it changes nothing about how you operate the rental.
Why lenders require it
A new LLC has no track record, often no assets beyond the property being purchased, and can be dissolved with a filing. Without a guaranty, a lender would be extending credit to a shell it cannot evaluate.
The guaranty solves this by putting real people with real credit histories behind the promise. That is precisely why entity vesting on a DSCR loan does not typically cost you leverage or program access: the lender's confidence comes from the property's cash flow plus the guarantors, not from the entity itself.
What a guaranty typically covers
Terms vary by program and document, so read yours. Broadly, a guaranty obligates the guarantor for repayment of the debt if the borrower entity defaults. Some guaranties also carve out specific bad acts, things like fraud or misapplication of rents, for which liability attaches regardless.
Ask your lender which structure your program uses and have counsel walk you through the carve-outs. The point of the exercise is not to alarm you. It is to make sure the obligations match what you think you are signing.
How guarantors are reviewed
Expect the members or principals with meaningful ownership to be treated as guarantors and reviewed accordingly. Credit is pulled on each guarantor, and the strength of those profiles helps drive terms alongside the property's coverage ratio, leverage, and reserves. What does not happen: nobody underwrites your personal income. Qualification stays anchored to the property's rent, so tax returns and pay stubs remain out of the picture even though your credit is in it.
Partners and multi-member companies
Guaranties get more interesting when several members are involved. Settle these questions with your partners before the application:
- Who signs? Typically the meaningful owners, so confirm how your ownership percentages shake out.
- What does the operating agreement say? Some agreements require member consent before anyone binds the company to debt.
- How is exposure shared? Guarantors are often each responsible for the obligation, not merely their pro-rata slice. Your attorney can explain how that works in your state and whether any internal reimbursement agreement between partners makes sense.

Does the guaranty follow you around afterward?
A question guarantors ask once the ink dries: is this obligation now part of my financial life everywhere I go? In practical terms, the guaranty lives with the loan. Refinance or sell the property and pay the note off, and the associated guaranty is extinguished with it.
Reporting practices for business-purpose loans vary, so if visibility on your personal credit file matters to you, ask the specific lender how they handle it rather than assuming either way. And when you apply for other credit, expect sophisticated lenders to ask about contingent obligations like guaranties; answer plainly, because seasoned underwriters treat a guaranty behind a self-covering rental as a routine fact of an investor's life, not a mark against it.
Questions worth asking before you sign
Bring these to your lender and your attorney: Which events trigger the guaranty? Are there carve-outs, and what are they? Does the guaranty survive a refinance or transfer? What happens if a member exits the company during the loan term? Good lenders answer these directly, because informed guarantors make for smooth, long relationships.
